1. The Information Y2Kidz Collects From Parents, How Y2Kidz Uses It
Y2Kidz collects personally identifiable information (“PII”) from parents as part of the registration process, and to obtain parental consent for use of their child’s information as described below in section 2. Information collected from parents as part of the registration process may include name, e-mail address, telephone number, and address. Parents will also be asked for credit card information as part of the registration process. Credit card numbers are handled by our payment processor and not stored by Y2Kidz.
Y2Kidz employs industry standard data security tools such as secure sockets layer to protect information that you submit. The site is continuously monitored, tested, and protected by Hacking Solutions against DDoS attacks and other Internet threats using OWASP standards. Unfortunately, even with these measures, we cannot guarantee the security of the information submitted, either by you or by your child. By using our Site, you acknowledge and agree that we make no such guarantee and that you use our Site at your own risk.
Y2Kidz will not use parent emails provided for parental consent purposes to market to the parent unless the parent has expressly opted into email marketing or has separately participated in an activity that allows for such email contact.
2. The Information Y2Kidz Collects From Children, And How Y2Kidz Uses It
The Site offers to its users a social media environment for children aged 7 to 14. The site offers a variety of activities, including some that may collect information from children using it. Sections 2 through 4 of this document summarize information is collected from children and outline how and when Y2Kidz will provide parental notice and/or seek parental consent for collection and use of such information. In the event Y2Kidz discovers it has collected information from a child in a manner inconsistent with COPPA’s requirements, Y2Kidz will either delete the information or immediately seek the parent’s consent for that collection.
(a) Initial Registration Information
Children can use the Site to view content, play games, participate in contests, and engage in special features, among other things. During the initial registration process, Y2Kidz will ask the child to provide the parent or guardian’s email address, the child’s member or account username, and password. Y2Kidz strongly advises children never to provide any personal information in their usernames. Please note that children can choose whether to share their information with us, but certain features cannot function without it. As a result, children may not be able to access certain features if required information has not been provided. Y2Kidz will not require a child to provide more information than is reasonably necessary in order to participate in an online activity.
(b) Child’s Personal Information and Child-Generated Content
The Site allows children to create or manipulate content and save it on the Site. The Service may collect information including: (i) Your child's email address, to allow your child's friends and acquaintances to become "friends" with your child on Y2Kidz; (ii) any profile information that your child chooses to upload, which may include: school name; grade in school; favorite school subject; hobbies and interests; and any "about me" biography information your child writes (this profile is only visible to Y2Kidz "friends", and it may be made completely private with a setting that your child can choose); (iii) Comments and thoughts your child writes on his or her "timeline" which is visible to “friends” only. (iv) items that your child discloses in "Space2Face" rooms with other Y2Kidz users; (v) a screen name that allows other Y2kidz users to chat with your child; (vi) photographs, video, and or audio that may contain your child's image and/or voice. This information may be visible to other users of the service if your child “friends” them, and some information such as screen name/username may be visible to all Y2Kidz users. Y2Kidz will retain personal information collected online from a child for only as long as is necessary to fulfill the purpose for which it was collected and delete the information using reasonable measures to protect against its unauthorized access or use. No activity will be conditioned on the child providing more information than is reasonably necessary to participate in that activity.
(c) Chat or “Space2Face”
Certain parts of the site that are directed to children allow users to communicate directly with other users by means of a chat system. In most cases, these chat systems employ filters that are intended to prevent the communication of both personal information and age-inappropriate words and phrases. In addition to filters, Y2Kidz may employ live moderation and/or encourage other users to flag inappropriate communications. Y2Kidz strongly encourages children who use these interactive features on the Site and applications never to provide personal information about themselves or any third party, and certainly never to attempt to circumvent Y2Kidz’s filters or moderation. Y2Kidz also recommends that parents carefully supervise their children when the children participate in online activities. The Child may participate in chat or “Space2Face” with members of the Y2Kidz staff, such as tutors, supervisors, and staff, to facilitate games, events, educational parts of the site, and provide general help and facilitation with the operation of the site.
(d) Contests and Sweepstakes
For contests and sweepstakes, Y2Kidz typically requires only the information necessary for a child to participate, such as first name and parent email address. Y2Kidz only contacts the parent for more personalized information for prize-fulfillment purposes when the child wins the contest or sweepstakes.
Some contests and sweepstakes ask the child to submit content they created. In those instances, Y2Kidz may require parental consent prior to submission. Please see “Child-Generated Content” above for more information on Y2Kidz’s collection, notice, and consent policies.
(e) Persistent Identifiers
When children interact with the Site, certain information may automatically be collected, both to make the Site and applications more interesting and useful to children and for various purposes related to Y2Kidz’s business. Examples include the type of computer operating system, the child’s IP address or mobile device identifier, the web browser, the frequency with which the child visits various parts of the Site or applications, and information regarding the online or mobile service provider. This information is collected using Online Tracking Technologies (defined above). This information may be collected by Y2Kidz or by a third party. This data is principally used for internal purposes only, in order to:
- provide children with access to features and activities on the Site and applications
- customize content and improve the Site and applications
- conduct research and analysis to address the performance of the Site and applications
- generate anonymous reporting for use by Y2Kidz
In the event Y2Kidz collects (or allow others to collect) such information from children on the Site and applications for other purposes, Y2Kidz will notify parents and obtain consent prior to such collection.
The list of third-party operators who collect persistent identifiers on the Site and applications may be found here.
(f) Push Notifications
Push notifications are notifications on mobile and other devices that are typically associated with downloaded applications, and which can communicate to the device holder even when the application is not in use. Y2Kidz will require a child to provide a parent email address before the child can receive push notifications from Y2Kidz’s child-directed applications that collect a device identifier. Y2Kidz will then provide the parent with notice of Y2Kidz’s contact with the child and will provide the parent the opportunity to prevent further notifications. Finally, Y2Kidz will not associate the device identifier with other personal information without contacting the parent to get consent.
(g) Geolocation Data
Some devices (cell phones, tablets, some digital cameras) may include geolocation data such as GPS coordinates in an image file. Y2Kidz may allow the child to upload and share image files with others on the Y2Kidz site in a way that also shares the geolocation data embedded in the image file. If the Site or related application collects other geolocation information that is specific enough to equate to the collection of a street address, Y2Kidz will first seek parental consent via email.
3. When Information Collected From Children Is Available To Others
Y2Kidz may share personal information with Y2Kidz’s service providers if necessary for them to perform a business, professional, or technology support function for Y2Kidz.
Y2Kidz may disclose personal information if permitted or required by law, for example, in response to a court order or a subpoena. To the extent permitted by applicable law, Y2Kidz also may disclose personal information collected from children: (i) in response to a law enforcement or public agency’s (including schools or children services) request; (ii) if Y2Kidz believes disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety or protect the safety of a child using the Site or applications; (iii) to protect the security or integrity of the Site, applications, and other technology, as well as the technology of Y2Kidz’s service providers; or (iv) enable Y2Kidz to take precautions against liability.
4. Parental Choices and Controls
At any time, parents can refuse to permit Y2Kidz to collect further personal information from their children in association with a particular account, and can request that Y2Kidz delete from Y2Kidz’s records the personal information Y2Kidz has collected in connection with that account. Such a request will lead to a termination of access to the Site.
